What Malaysian law does—and does not—answer
Third-party risk is the legal baseline
Section 90 of Malaysia’s Road Transport Act 1987 addresses insurance or security for third-party risks when a motor vehicle is used. That legal baseline is not the same as a complete answer to a renter’s contractual liability for the rental vehicle, excess, excluded damage, towing, administrative charges or downtime. Those details must come from the applicable policy and rental agreement.
Accident reporting has a legal timetable
Section 52 requires a driver involved in a road accident to stop, provide specified particulars when reasonably required, report the accident at the nearest police station as soon as reasonably practicable and in any case within 24 hours, and render reasonable assistance.
